PROTOCOL FOR HANDLING PLAGIARISM CASES

Article One


The purpose of the protocol is to ensure that the activities against academic misconducts are conducted academically, professionally, and legally; to protect scholars’ legal rights; to prevent the innocent people from harm.

Article Two


China Academic Integrity Review (AIR-China) establishes Plagiarism Collections, which are headed by their respective Moderators. The Moderators are selected by the Coordinator of AIR-China from those who applied for the position or those recommended by other members of AIR-China.

Article Three


AIR-China forms Academic Misconduct Assessment Panels, each Panel consists of 3-5 people. The Panels are convened by the Coordinator of AIR-China when necessary, each Panel is responsible for each individual case. The Moderator, the Plaintiff, and the Defendant are not eligible to be a panelist. A panelist must meet one of the following qualifications:

Item One: Who had filed a complaint before and the defendant was convicted by a Panel;

Item Two: Who has published articles in relevant areas;

Item Three: Who has gained his/her reputation and credibility through his/her posts in the forums;

Item Four: Who has relevant professional or legal knowledge.

Article Four


To file a Complaint against a plagiarism case, the Plaintiff should send the Complaint Document to the Moderator for Preliminary Examination. If the Moderator wants to file a Complaint, he/she should excuse his/her responsibility of Moderator, and ask the Coordinator to take over the job, or the Coordinator can assign another person to be in charge of Preliminary Examination.

Article Five


After Preliminary Examination, if the Moderator believes that the Complaint Document needs amendment or supplement, he/she should notify the Plaintiff as such; if the Complaint Document still doesn’t pass Preliminary Examination after amendment or supplement, the Moderator should notify the Plaintiff that the complaint is not accepted. The Plaintiff has the rights to post his/her Complaint on the forums of AIR-China, and he/she is solely responsible for the consequences.

Article Six


The Complaint Document must meet the following criteria:

Item One: It must give the following information of the allegedly plagiarized article: title, author(s), time of publication, location of publication, web link if available, and the complete text of the article;

Item Two: It must give the following information of the article being plagiarized: title, author(s), time of publication, location of publication, web link if available, and the complete text of the article. If possible, it should provide the contact information of the victim(s).

Item Three: It must provide the evidence of plagiarism:

1. Verbal plagiarism: Text comparison must be provided;

2. Idea plagiarism: Valid demonstration or argumentation must be provided;

3. Action plagiarism: The time and location of the repeated publications must be provided.

Item Four: The Plaintiff should perform a complete and comprehensive analysis of the entire article in allegation, rather than limit his/her analysis to a certain portion of the article;

Item Five: The Plaintiff should make a qualitative or quantitative assessment of the case based on prevailing rules and laws;

Item Six: The Complaint Document must be intact and self-contained, rather than merely provides clues, suspicions, speculations, or conjectures;

Item Seven: A model Complaint Document should be similar to “The Myth of Transgenic Corn,” written by Six-fingered;

Item Eight: When submitting the Complaint Document, mark the document as such.

Article Seven


Once a Complaint passes Preliminary Examination, it must be sent to the Defendant by the Coordinator to give the Defendant the chance to defend for himself/herself. The documents sent to the Defendant should contain the Complaint Document, the Protocol for Handling Plagiarism Cases, and the Moderator’s contact information.

Article Eight


The Defendant has five days to respond to the allegation. If the Defendant refuses to respond in five days, or his/her response is not satisfactory to the Moderator, the Moderator will post the Complaint Document at the top of the main forum of AIR-China under the title 【So-and-so is suspected of plagiarism】for Public Notice. If the Defendant requests extra time to prepare his/her response, the request should be considered at the discretion of the Moderator.

Article Nine


During the Public Notice period, the Coordinator should convene or designate an Academic Misconduct Assessment Panel. Once the Public Notice is over five days, the Panel should vote in appropriate time frame on whether the allegation is true or not, and issue a Verdict, which should be based on the opinion of the absolute majority of the panelists.

Article Ten


The Verdict should be written by a panelist from the majority, the other members of the Panel should explicitly express their opinion individually as either Yes or No. The Verdict should be clear and concise, but must state the facts, the criteria, and the opinion on the allegation. The Verdict should be in Chinese and English, the Chinese version is the original. The Verdict should be posted by the Coordinator at the top of the main forum of AIR-China for at least one week.

Article Eleven


Once a Panel convicts a plagiarism case, the Panel should issue a Certificate of Plagiarism, in both Chinese and English. The Certificate should contain a serial number, a brief introduction of the plagiarizer, specific fact of plagiarism, and issue date, etc.

Article Twelve


Once a Panel convicts a plagiarism case, the Moderator should archive all the relevant documents and save them in the Plagiarism Collection permanently.

Article Thirteen


Once a Panel convicts a plagiarism case, the Coordinator should, on behalf of AIR-China, send the Verdict and the Certificate to the following institutions and individuals:

Item One: The Plaintiff, the Plagiarizer, the Victim(s), etc.;

Item Two: The schools the Plagiarizer has attended (including secondary, college, and graduate schools);

Item Three: The plagiarizer’s current employer(s) (including his contractors);

Item Four: The newspaper, magazine, website, or publisher who published the plagiarized article;

Item Five: News agencies, such as Xinhua News Agency, China News Network, etc.;

Item Six: Government agencies, such as National Copyright Administration of China, General Administration of Press and Publication of China, etc.;

Item Seven: Western mainstream media, such as Associated Press, New York Times, Science magazine, journal Nature, etc.;

Item Eight: Brother websites, such as www.acriticism.com, [www.rainbowplan.org], www.gmw.cn/, www.xiaochuanguo.net/, plagiarism.org, etc.

Article Fourteen


Once a Panel acquits a case, the Moderator has the right to appeal to the Coordinator, and the Coordinator can either accept or reject the appeal. Unless there is new evidence, the rejected case cannot be appealed again. If the appeal is accepted, an Appellate Panel will be convened, and the Appellate Panel will review the case all over again. The Appellate Panel’s judgment is final. Once an Appellate Panel acquits a case, the Moderator is responsible to archive all the relevant documents, and must mark the documents that the case has been acquitted by an Appellate Panel.

Appendix


The copyrights of the Complaint Documents and the Defendant’s Rebuttals are shared by the authors and AIR-China. The copyrights of all other documents belong to AIR-China exclusively. Please contact the Coordinator if a news medium wants to use the articles in the Collection.




抄袭剽窃案例认定程序


(2010年12月9日公布;2011年1月7日修改)


第一条 为确保打击学术不端行为的活动学术化、规范化、合法化,保护学人的正当权益,避免伤及无辜,特制定此程序。

第二条 中国学术评价网目前下设“方舟子系列”专题,该专题下设“抄袭剽窃专辑”,该专辑由专人主持。专辑主持人(简称主持人)由自己申请或者网友推荐,由版主任命。主持人实行任期制,每期一年。

第三条 本网站设“学术不端行为评议团”(以下简称“评议团”),由3-5人组成。评议团由中国学术评价网版主负责临时召集或指定,一案一团,主持人、举报人、被举报人不得出任其成员。评议团成员必须具备以下资格之一:

一、曾经成功举报过抄袭剽窃案例;
二、曾经发表过有影响的相关文章;
三、在论坛上的发言公允持重,具有相当的公信力;
四、具备专业知识或者相关法律知识。

第四条 举报抄袭剽窃行为的文章,由举报人通过私信递交主持人进行初审。主持人充当举报人时,需委托版主暂时代理或者指定临时主持人进行初审。

第五条 经主持人初审,认为需修改或补充材料的,由主持人通知举报人;经过修改或补充材料仍未通过初审的举报文章,由主持人通知举报人不予立案;举报人可在本网站自行张贴,文责自负。

第六条 举报文章应符合下列规范:

一、请说明抄袭文章的标题、作者、发表时间、出处(报刊或网站名称),以及链接地址,并提供原文全文;
二、请说明被抄袭文章的标题、作者、发表时间、出处(报刊或网站名称),以及链接地址,并提供原文全文。如果可能,请提供被抄袭人的联系方式;
三、请提供抄袭的事实:

1.文字抄袭:必须提供文字对比;
2.观点抄袭:必须提供严密可靠的论证;
3.抄袭行为:曾经重复发表的抄袭文章,应罗列每次发表的时间、出处。

四、请对一篇文章尽可能做全面的分析和比较,而不是仅限于个别字句、部分段落的比较;

五、请根据现行法规对抄袭行为作出定性或定量的评价;

六、举报文章应完整成篇,自成一体,而不仅仅是提供线索、怀疑、猜测和揣测;

七、举报范文参见六指的《转基因玉米的神话》(链接:[www.2250s.com]);

八、来稿请注明“举报”字样。

第七条 通过初审的举报文章,由主持人发函送达被举报人,请其为自己辩护。送达文件应包括举报文章、审理程序和主持人联系方式。

第八条 在通知被举报人五天之后,如果被举报人拒不答复,或者答复不能使主持人满意,主持人将以【某某涉嫌抄袭剽窃】为题,将举报文章在本网站主论坛予以公示,接受公众的评论和质疑。如果被举报人要求延长辩护期,可以酌情考虑。

第九条 公示期间,由版主召集或者指定评议团。公示五天之后,由评议团在适当时间内对指控是否成立做出表决,并出具评议书。评议团的认定结果以绝对多数成员的意见为准。

第十条 评议书由评议团多数派一方推举一人撰写,由评议团其他成员表态支持或反对。评议书宜简明扼要,但须开列认定事实、认定标准以及对举报意见是否赞同。评议书中、英文各一份,中文为正本。评议书由版主在本网站主论坛置顶公布至少一周。

第十一条 经评议团认定为抄袭的案例,以评议团名义颁发认定证书(Certificate of Plagiarism)。认定证书中英文各一份,须包括编号、抄袭人简介、具体抄袭事实、认定日期等内容。

第十二条 经评议团认定为抄袭的案例,由主持人负责编号,并连同相关文件一起收入“抄袭剽窃专辑”,永久保存。

第十三条 评议团认定抄袭案成立的评议书、认定证书由版主以中国学术评价网的名义递送以下单位和个人:

一、举报人、抄袭人、被抄袭人等相关人员;
二、抄袭人曾经就学的学校(包括中学、大学、研究生院);
三、抄袭人现在供职的单位(包括提供专栏写作的报刊、提供合同服务的公司企业);
四、发表抄袭文章和被抄袭文章的报刊、网站、出版社;
五、新华社、中国新闻网等新闻机构;
六、中国国家版权局、国家新闻出版总署等政府机构;
七、美联社、纽约时报、科学杂志、自然杂志等西方主流媒体;
八、学术批评网、虹桥科教论坛、星湖沙龙、光明网、声援肖传国教授网、plagiarism.org等兄弟网站。

第十四条 评议团认定不构成抄袭的案例,主持人可向版主提出上诉,版主可予以接受或驳回。除非有新的证据,被驳回的案例不得再次上诉。版主如接受上诉,应组织上诉评议团,重新审理此案。上诉评议团的评议结果为本网站做出的最终结论。经上诉评议团否决的案例,由主持人负责保留所有相关文件,但须注明此案被评议团最终否决。
