11月6日,协和医院决定“免去肖传国泌尿外科主任、《临床泌尿外科杂志》主编职务;给予其行政记大过处分和待岗察看一年处理;按照《执业医师法》的有关规定上报卫生行政部门作出相应的处理”。对此方舟子评论说“在美国,医生一旦犯罪,就会被吊销行医执照,永远当不成医生了。协和协和,对罪犯也要和谐”。作为受害人,方舟子可以把两个米粒大的伤说成是有人要他的命。可作为“中国的良心”,方舟子的这个评论实在是太昧良心了。

在美国,行医执照由各州自行管理。虽然规定各有不同,但从来没有“医生一旦犯罪就永远当不成医生了”的说法。下面摘录两段加州和纽约州的规定,从中读者很容易看出方舟子说法的荒谬性。一般说来,如果一个医生有犯罪纪录,那么他的行医资格是会受到质疑。但他的行医执照却未必会被吊销(revoked),有些甚至不会被暂停(suspended)。加州的规定强调只有当罪行与医生的职责有关时才会受到处罚。纽约州的规定强调他们要综合考虑犯罪的背景,动机,认罪态度等各方面的因素,并由此来决定是否暂停或吊销行医执照。换句话说,“在美国医生一旦犯罪就会被吊销行医执照”是百分之百的无稽之谈。

有的读者可能会感到奇怪。美国号称法制社会,怎么会允许犯法的医生行医呢?
可这事实上正是法制的表现。比如一个医生闹离婚时对法庭的判决不满,对法官出言不逊,那就可能(依情节轻重)被判有罪。但这种罪对行医影响很小所以一般不会被吊销行医执照。

那么美国对恶性犯罪的医生是什么态度呢?1979年,佛吉尼亚州的肖尔医生因枪杀妻子被以二级谋杀罪判处八年徒刑。肖尔医生的行医执照也因此被吊销。九年后,肖尔医生的行医执照被恢复,并被允许在其他医生监督下行医。1990年,肖尔医生被允许独立行医。这个例子说明了“医生一旦犯罪就永远当不成医生了” 的说法纯属一派胡言。

现在的问题是为什么方舟子要散布这种与事实截然相反的言论呢?难道是因为方舟子对美国医疗界的情况不熟悉?这不应该不会,方舟子即定居美国,又是搞“XX 医学”的,怎么会连这点常识都不明白?再说了,即使拿不太准,凭着方舟子“对真相有洁癖”的个性也是应该一下子就搞清楚才对。看来只能是另一种可能,就是方舟子所说的“骗子的目的就是要骗人,能蒙倒一个算一个”。

西方人有句话:“骗我一次是你狠;骗我两次是我蠢”。这些年来,从加碘盐到打疫苗,方舟子告诉了我们好多“国际惯例”。而这些“国际惯例”的共性就是每一次都会被人戳穿。希望经过这次之后,善良的人们不再轻易受骗。若能如此,本文的目的也就达到了。

Criminal Convictions and Their Impact on California Medical Licenses

It’s a well known fact that when a licensed physician is convicted of engaging in prescription fraud, medical fraud, insurance fraud, or inappropriate behavior with a patient, it’s pretty much a given that he/she will be disciplined. This is because the Medical Board of California governs its licensees when it comes to criminal convictions. Depending on the individual circumstances, it may (1) suspend, revoke, or deny a medical license, (2) warn the license holder, or (3) place the license holder on probation.

The key is whether the conviction is “substantially related” to the qualifications, functions, and/or duties of being a doctor. If the Medical Board believes that the offense is substantially related to being a physician, it will discipline the license holder. This is why it is advisable to consult with a skilled California criminal defense attorney who knows the most effective arguments to convince it otherwise.

While criminal conviction will result in professional discipline, it is not at all certain that the doctor's license will be suspended or revoked. A properly presented defense may use mitigating factors that could significantly minimize potential disciplinary measures taken by the Department of Education. For example, one could expect the penalties to be less severe if the crime has very little connection to the practice of medicine, if it is a relatively minor offense, if the crime "victimless", if the doctor has no prior criminal history, if public would not be endangered by the doctor's practice of medicine, and the like.
